PHOTO/VIDEO RELEASE I hereby grant permission to the rights of mine and my child’s image, likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that mine and my child’s image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein mine and my child’s likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of mine and my child’s image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area. Photographic, audio or video recordings may be used for the following purposes: conference presentations educational presentations or courses informational presentations on-line educational courses educational videos training videos promotional purposes By agreeing to this release I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in a public setting. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio or video recordings collected as part of the sessions listed on this document. By agreeing to this release, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material. Waiver 

 

  In consideration of participation at TNT Gymnastics, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own action, or inaction, those of others participation in the event, the conditions in which the event takes place, or the negligence of the “releasees” named below, and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity. I hereby release, discharge, and covenant not to sue TNT Gymnastics, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the “RELEASEES” herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligent rescue operations and further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save and ONE DAY EVENT WAIVER hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim.

 

COVID-19 Waiver Addendum 

 

I _____________________ (parent/guardian name) understand that I am opting for my child to participate in elective activities at TNT Gymnastics and Cheerleading. I also understand that the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. I further understand that COVID-19 is extremely contagious and is spread by person-to-person contact; and as a result, federal and state health agencies recommend social distancing. I recognize that TNT Gymnastics and Cheerleading and all its staff are closely monitoring this situation and have put in place reasonable preventative measures aimed to reduce the spread of COVID-19. However, given the nature of the virus, I understand there is an inherent risk of becoming infected with COVID-19 by virtue of participating in all activities at TNT Gymnastics and Cheerleading. I hereby acknowledge and assume the risk of my child/children and/or myself of becoming infected with COVID-19 by electing (for my children) to participate in all activities at TNT Gymnastics and Cheerleading. I understand all the potential risks, including but not limited to the potential short-term and long-term complications related to COVID-19 and I would like my child/children to participate in all activities at TNT Gymnastics and Cheerleading.    

 

  INFORMED CONSENT FOR COVID-19 RISK 

 

I understand the explanation and have no more questions and I consent to my child/children’s participation in all activities at TNT Gymnastics and Cheerleading. I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AGREEMENT AND COVID-19 WAIVER, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effort. PARENTAL CONSENT AND I, the minor’s parent and/or legal guardian, understand the nature of the above referenced activities and the Minor’s experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby, Release, discharge, covenant not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releasees from all liability, claims, demands losses or damages on the minor’s account caused or alleged to have been caused in whole or in part by the negligence of the FAM-1 | 01/08/2023 Page 4 of 5 Releasees or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor, or anyone on the minor’s behalf makes a claim against any of the above Releasees, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, loss liability, damage, or cost any Releasee may incur as the result of any such claim. This agreement shall be subject to and governed by the laws of the State of New Jersey. Venue for all actions arising out of this agreement or otherwise arising between the parties hereto shall be brought only in the Superior Court of New Jersey, Burlington County, or in the United States District Court for District of New Jersey. All disputes arising out of or in connection with the present contract shall be finally settled under the rules of arbitration by one or more arbitrators appointed by said court.
